Terms of use

1. Operator and service

YB Video is operated by Yoann Bierling, sole trader (micro-entrepreneur), 20 rue Erckmann Chatrian, 57400 Sarrebourg, France. Contact: [email protected]. YB Video provides an AI-assisted service for creating short videos from user instructions and optional visual references.

2. Eligibility and accounts

You must be at least 18 years old and legally capable of entering into a contract. You confirm your age during registration. Provide accurate information and keep your login credentials confidential. You are responsible for activity performed through your account.

3. Plans, prices and payments

Prices are displayed in US dollars. Available products, prices and credit allowances are shown on the pricing page and at checkout. Payments are processed by Stripe. Applicable taxes, if any, are determined according to the customer's location and applicable rules.

4. Credits and generation

Credits are usage units and have no cash value. Each Low video costs 100 credits, each Mid video costs 200 credits, and each High video costs 300 credits. Every video is 10 seconds. Current provider availability is shown in the Studio and may change.

Subscription credits are included with an active monthly or annual subscription. They are issued for each subscription credit period, do not roll over, and expire at the end of that credit period. Annual subscriptions are billed annually, while their included subscription credits are issued monthly. When you upgrade a subscription, the new plan starts immediately, the new subscription period begins, and the previous subscription-credit allocation is replaced by the new plan's allocation. When you downgrade, the new plan starts immediately. The current subscription month is non-refundable, unused future months of an annual payment are refunded separately, and the new plan's subscription-credit allocation is available immediately.

Purchased credit packs are separate from subscription credits and remain available regardless of subscription upgrades, downgrades, cancellation or expiry. Purchased pack credits are valid for 360 days from purchase. Bonus credits, including promotional, referral or other complimentary credits, are separate from subscription credits and expire 30 days after they are granted unless a different expiry is expressly stated when they are granted.

When credits are used, YB Video uses the credits with the earliest expiration first. In the normal case this means bonus credits first, then monthly subscription credits, then purchased credits. If a purchased pack expires sooner than another available lot, it is used sooner. Expired credits are removed from the available balance.

Credits are deducted when a generation is submitted. If generation fails, YB Video will review whether the provider billed the generation. Credits will be restored when YB Video has not been billed for that failed generation. If the provider billed YB Video, credits are not automatically restored; this does not limit mandatory consumer rights.

5. Subscriptions, plan changes and cancellation

Subscriptions renew automatically at the selected billing interval until cancelled. You may cancel through the subscription management option where available or by contacting us. Cancellation stops future renewals; access and subscription benefits continue until the end of the paid billing period, subject to applicable law.

Subscription upgrades take effect immediately. The full price of the new subscription period is charged; no prorated credit or charge is applied. The new plan's subscription-credit allocation replaces the previous subscription-credit allocation for the new credit period. Purchased credit packs and bonus credits are not affected.

Subscription downgrades take effect immediately. The current subscription month is non-refundable; for annual plans, unused future months are refunded separately. The new plan and its subscription-credit allocation are available immediately.

6. Refunds and withdrawal rights

For a voluntary refund request made within 14 days of purchase, YB Video may refund the value of unused, unspent credits from a one-time credit purchase. Credits already spent on generation are not included in this voluntary refund policy. Contact [email protected] with your account email and payment reference.

This voluntary policy is separate from statutory withdrawal rights and legal remedies. Where a statutory 14-day withdrawal right applies, its application to digital content or digital services depends on the contract and legally required information, consent and acknowledgements. Nothing in these terms waives rights that cannot legally be waived, including remedies for non-conforming services.

7. User content and acceptable use

You must own or have all permissions and rights required to upload images and request content. You may not submit content or use outputs in a way that infringes intellectual property, privacy, publicity or other rights, violates applicable law, or breaches provider policies. Do not use the service to create unlawful, deceptive, exploitative or abusive content, or to impersonate a person without appropriate authorization. You remain responsible for your prompts, uploaded material, generated videos and their publication or use.

8. AI-generated output

AI outputs may be inaccurate, inconsistent, incomplete, similar to outputs created for others, or unsuitable for a particular purpose. Review outputs before use. Commercial use is permitted only to the extent allowed by applicable law and the terms and rights governing the provider, model, input content and output.

9. Availability and storage

Provider availability, model capabilities, generation times and output retention may vary. Generated videos may be hosted temporarily by providers and/or our hosting account; links may expire. YB Video does not promise permanent video storage. You should download and retain any output you need.

10. Liability

Nothing in these terms excludes or limits liability where prohibited by law. To the extent permitted by law, YB Video is not responsible for indirect or consequential loss. You are responsible for maintaining copies of outputs you need and verifying that their use is lawful and suitable.

11. Governing law

These terms are governed by French law, without prejudice to mandatory consumer protections and jurisdiction rules.

12. Referral and affiliate programs

If enabled, approved affiliates may receive a 5% recurring commission on qualifying subscription payments attributed to their referral link. Commissions are subject to a 45-day validation period and are not payable for refunded, disputed or reversed payments. One-time credit pack purchases do not generate commissions. Payouts are made manually; affiliates are responsible for their tax reporting. Participation may be suspended for fraud, self-referrals, misleading promotion or breach of these terms.
